Philly Loses Bid to Boot Scouts

A Philadelphia federal jury ruled unanimously Wednesday that the city violated the First Amendment rights of the Boy Scouts of America when it cited the group's discrimination against gay people in an attempt to evict a local Scouts council from a city-owned building.

"We can't be kicked out of the building or evicted and we don't have to pay any rent," Scouts attorney William M. McSwain said of the verdict.

Lawyers for the Scouts say they expect U.S. district judge Ronald Buckwalter to issue an injunction against the Scouts’ eviction. Still, the city’s lease allows it to evict the Scouts without giving a reason.

Buckwalter told the jury he hopes the Scouts council and the city can negotiate a solution.

    The Bigoted Scouts of America win another round but the war continues. I have been following this for several years. Evidentally from what I have read the bigots maintain the building with their money and have remodeled it over the years. They did sign a lease with the city before this all blew up. So I am not sure where that leaves the situation. I am hoping of course that whatever happens the bigots are the loser. But then they already are losers in a sense. Stay tuned for more suspense.

    I think it has been well established that the Scouts have a right, as a private organization, to discriminate. What they do NOT have a right to, is preferential rent treatment. Of course they cannot be evicted. They CAN be charged a fair market rent.

    Why is the rent $1 a year? How much tax money goes in to maintenance and up keep of the building? Raise the rent to reflect that so its fair to tax payers. Maybe its all of the $1 rents from tenents and $$$$$ out lay of maintenance and upkeep of 'public' buildings is why taxes keep going up.

    @Charles, even though the City doesn't need a reason to evict, it still cannot evict them for an illegal reason. It's like with employment, an employer can generally fire you without giving a reason, but if you prove that the employer actually fired you because of your race a judge can order that it rehire you with backpay.

    Can someone proofread this article please. Seems like something is missing. The paragraph that starts: "Lawyers for the scouts say…" I also don't understand, if the lease says they can evict with no reason, why the lawsuit?

    The city should have just done it on monetary grounds. In a recession, the city needs all the money it can get. If they can rent out the property to someone who's willing to pay a fair price, then they should.

    Am I the only one who couldn't make sense of, "Lawyers for the Scouts say they expect U.S. District Judge Ronald Buckwalter that bars the Scouts' eviction." And why did it even wind up in court if the city's lease allows nthem the eveict the Scouts without giving a reason? Something's wrong here (besides the idiotic court decision).
