U.S. to Support U.N. Gay Rights Declaration



The Obama administration will support a United Nations declaration affirming that sexual orientation and gender identity are included in international human rights protections, the Associated Press reported on Tuesday evening.

According to officials, who spoke on the condition of anonymity because members of Congress were still being notified, the Obama administration had reviewed the reasons why the Bush administration opposed the declaration, and had decided to notify its French sponsors that the United States would support it.

The U.S. State Department issued an official statement Tuesday afternoon: "The United States supports the U.N. Statement on 'Human Rights, Sexual Orientation, and Gender Identity,' and is pleased to join the other 66 U.N. member states who have declared their support of this Statement that condemns human rights violations based on sexual orientation and gender identity wherever they occur. The United States is an outspoken defender of human rights and critic of human rights abuses around the world. As such, we join with the other supporters of this Statement and we will continue to remind countries of the importance of respecting the human rights of all people in all appropriate international fora."

The United States originally did not join more than 60 countries that signed the historic declaration in December, putting the U.S. in the company of gay rights opponents such as Egypt, Saudi Arabia, Uganda, and the Vatican. The Bush administration rejected the non-binding declaration on technical legal grounds concerning federal and state jurisdiction over gay rights.

Article 1.

All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.

Article 2.

Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, colour, sex, language, religion, political, or other opinion, national, or social origin, property, birth, or other status.

Article 3.

Everyone has the right to life, liberty, and security of person.

Article 12.

No one shall be subjected to arbitrary interference with his privacy, family, home, or correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks.

The International Covenant on Civil and Political Rights (adopted by General Assembly resolution 2200A [XXI] of 16 December 1966, entry into force 23 March 1976)

Article 17

1. No one shall be subjected to arbitrary or unlawful interference with his privacy, family, home, or correspondence, nor to unlawful attacks on his honour and reputation.

2. Everyone has the right to the protection of the law against such interference or attacks.

We ask the United Nations to request a universal abolition of the so-called "crime of homosexuality," of all "sodomy laws," and laws against so-called "unnatural acts" in all the countries where they still exist.

    GO OBAMA said, "This is the FIRST major move for Gay Rights..." he also seems to think that Obama couldn't - with an Executive Order - abolish the use of DADT and just proclaim the military open for ALL to serve in, not just hets. First off, GO OBAMA, how is this a "MAJOR MOVE FOR GAY RIGHTS" when it does absolutely NOTHING??? Is it enforceable? Are there sanctions if it's not adhered to? What repercussions does a country face if they choose to ignore it? How can we (the USA) endorse it when we don't even adhere to it here in the United States??? And quite frankly, if Obama isn't going to use the power of Executive Orders, then he's a fool, a wimp, and hardly worth your continued planting of your tongue up his ass.

    I'm proud of President Obama signing this important UN. Human Rights Gay Declaration. How could you expect the last President to do that when he condoned torture? This is just the start in the U.S., give President Obama a chance to put our United States on it's feet again, and he will, as he said, "some people can chew gum and walk at the same time". The tirade from Marion shouting on her comment is because she feels that what she believes, because of her religion. is right. Marion there are many Christians throughout this world who think you're wrong, including me.

    All I've seen about this meaningless UN resolution is shoddy, straight-pleasing journalism. This one is the worst. It goes as far as to cite certain articles of the UN's Universal Declaration of Human Rights but leaves out the most important ones (at least for the US): UDHR 16.1: Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution. UDHR 23.1: Everyone has the right to work, to free choice of employment, to just and favourable conditions of work and to protection against unemployment. I'm not saying that it wasn't the right thing to do. I think that it is a great empty gesture to go back and sign it over the Bush administration, but I'll certainly be happier when Obama actually does something that supports articles 16.1 and 23.1, that is a trans and military inclusive ENDA and federal marriage rights.

    I hope everybody forgives MerryAnne's blindness--and that of others with similarly strident, condemning opinions of ANY group of people. If she is not LGBT she has no idea how it feels not to be acknowledged as a person, thus to be invisible, and therefore bad. (Though because she seems threatened, angry, and bitter she likely has emotional turmoil of her own, which I do not mean to minimize.) I am surprised but grateful that this declaration has occurred in my lifetime, for it is a small healing moment for me and, more importantly, it lays a path toward acceptance for gay kids to come so that they won't be socially influenced to grow up hating themselves.
