Gay Man Not Guilty of Kidnapping

A Salt Lake County jury acquitted David James “D.J.” Bell (pictured) of kidnapping and burglary charges on Friday, ending a bizarre case in which he and his partner were severely beaten by their neighbors after Bell brought two children from a loud drinking party next door to sleep at his house.

An eight-person jury found Bell not guilty of the charges brought by his neighbor, Lulu Latu, who discovered her 2-year-old daughter and 4-year-old nephew in his home after a rowdy Fourth of July celebration concluded at her house in 2008, according to The Salt Lake Tribune.

“The 3rd District Court jury of five men and three women took less than three hours to acquit Bell of two counts of first-degree felony child kidnapping and one count of second-degree felony burglary,” reported The Salt Lake Tribune.

After the children were discovered in Bell’s home, relatives returned and severely beat Bell and his partner, Daniel Fair. Bell’s defense attorneys maintained that the case was better understood as a hate crime against Bell and Fair.

The Salt Lake County district attorney’s office may consider assault and burglary charges against Bell and Fair’s attackers, now that the kidnapping and burglary case against Bell has concluded.

    Cont. This call was placed almost an hr after she had retrieved her kids from their home and only after she heard someone else in the home on the phone with 911. The South Salt Lake City police department never investigated any of it, they never even took statements from the other people in the home while the assault was taking place. Even after the matter the family continued to taunt the others that lived in the house. It was clear that the only concern that the police dept had was for the alleged kidnapping. The mother also told the police several differant stories, even on the stand she could not keep her stories straight. The father of the one child who has a very colorful criminal record for assault pleaded the 5th. Only now is the DA's office looking into investigating because they are all stuck with egg on their face and one big ass band aid on their butts. Even the jury said this case should never have made it to trial.

    I am very good friends of DJ & Dan Fair. Although i was not there that night, i do have other friends that were in the house at the time this was all taking place. Long before this the kids in question have never been supervised they have always been able to run the neighborhood freely. The owner of the home where the incident took place flew in from Colorado and testified to this fact. The kids had gone over to DJ's on their own free will, dj and dan were in their bed asleep when the kids rang the door bell. Dj had been at the neighbors earlier that evening celebrating with them, he was a guest of the family. The one thing that never came out in court that was not allowed to be heard was the 911 call from the woman they call a mother. She clearly stated in her call that the police needed to get over there before her family killed them, you could hear her yelling at her family to stop, they have had enough, they cannot take anymore.

    You just accused all "straight" people who drink as being abusive and neglectful parents, which is not the case! If you don't want "straight" people to generalize what the "gay" people do, than I suggest you give them the same courtesy. This just goes to show that "gay" people can be just as judgemental as "straight" people. Which I guess just shows you once again how similar we all are!

    Yeek - Just because you are gay and have a kid doesn't justify your ignoring the facts of the case. Mr. Bell did not remove the kids from their home. The kids went next door on their own. There not multiple accounts in this case, there are only two accounts - Mr. Bell's (corroborated by the kids) and the Mothers (who was drunk). Forget you own kids and open you eyes, this was a case of hysterical homophobic rage against Mr. Bell, it had little to do with the children and certainly nothing to do with your own.

    This is a tricky case with a lot of VERY different accounts of what happened. I have to say that IF Mr. Bell entered the neighbor's house and removed the children without notifying the parents, then that's a form of vigilante justice as well. Unless there is a sincere belief of immediate threat to the life of the child (not "an inappropriate situation," not "poor parenting," etc.) then I can't honestly justify carrying off someone's kid. I'm gay and I have a kid and I would be driven to panic and rage if someone carried her off from a party without telling me, no matter how noble their intentions. However...if the attackers had no reason to believe there was an actual abduction going on, or knew the kids had already been removed from the house, or knew there was a misunderstanding...they're guilty.

    also it was maintained the men did not bring the kids home from the party, the kids came to their front door and rang the doorbell at 4am and the guys let them into their house and while they were getting dressed to take the kids home the mom saw them in a window got the kids and sent the angry mob.

    I was so exited about the verdict. I live in a very small town in the middle of nowhere and in these communities you have to be careful all the time. Its a shame you can't look after the neighbors well being and their kids safety without being in fear for your life or freedom. More and more law enforcement are turning a blind eye to attacks on our community and all these repressed pent up conservatives who recently found a voice are starting to come out of the wood work doing more damage with there half thought through assumptions. At least there are some bright points of light still happening out there!

    Phillip you are an idiot. these gay man at least had the sense to protect those children form their clearly alcoholic abusive parents who were more concerned with partying than their own kids...why did they not even KNOW where their kids were until "the party concluded"? Because like most straight parents...their own needs and partying are so much more important than their kids who they only think of as mistakes, and inconveniences!! thank god for those gay men who took care of those kids....someone has to...because CLEARLY those parents cannot. and I hope they enjoy the prison time they receive for assault..and burglary. they deserve it!

    @Phillip from Reseda: From my understanding DJ Bell and his partner never entered the house to "kidnap" the children. The children, during one of the loud parties their families liked to hold, wandered to their neighbors who took them in out of concern for their well-being. How are they repayed? by angry neighbors jumping to unfair homophobic conclusions and being brutally beaten. I've only been loosely following the case so I may be wrong about details.
