Miami Beach to Be Sued for Wrongful Arrest, Officers Reassigned

The American Civil Liberties Union is planning to sue the city of Miami Beach, Fla., claiming the city allowed two cops to harass a former resident.

Harold Strickland says he was harassed and wrongfully arrested after he called 911 to report two police officers beating another gay man near a popular local park, Flamingo Park, in March 2009, according to a statement from the ACLU.

According to the statement, the man who was beaten, identified only as John Doe, was chased by Miami Beach police officers into a parking lot and beaten. As the officers chased him, he yelled, "Who are you?" and "Why are you chasing me?"

Strickland witnessed the chase and assault, and he called 911, telling a dispatcher that the man had been handcuffed and was being kicked "like his head was a football." Strickland attracted the attention of the two officers beating Doe, and they demanded to know what he was doing. They took his cell phone and ended the 911 call. When he said he was reporting the brutal attack, one officer told him, "We know what you’re doing here. We’re sick of all the fucking fags in the neighborhood.”

The ACLU statement says the officers then pushed Strickland to the ground and tied his hands behind his back. They continued to threaten him and sling antigay slurs at him until they took him to the police station. He was charged with loitering and prowling, charges the state's attorney later declined to prosecute.

Robert Rosenwald of the ACLU of Florida says gay men have been targets of the Miami Beach police force in the area of Flamingo Park for decades.

"Often, police target gay men walking near Flamingo Park for nothing more than looking ‘too gay,’” Rosenwald says. adding that "Strickland fulfilled his civic duty by reporting what he recognized as police misconduct, but as a result he became the subject of verbal abuse and wrongful arrest."

Strickland, 45, now lives in Los Angeles.

In a notice to the city, required before filing a lawsuit, the ACLU demanded that the Miami Beach Police Department institute immediate remedial action to halt the harassment, intimidation, and arrest of gay men near Flamingo Park and individuals who observe, document, or report police misconduct.

The message also noted that Miami Beach police have a history of arresting people who witness police misconduct, particularly African-Americans.

The Miami Beach Police Department released a statement Thursday regarding the alleged incident:
 
"The City of Miami Beach became aware yesterday (Wednesday, February 3, 2010) of an incident that was reported to have occurred almost one year ago. As a result of these allegations, the Police Chief immediately ordered an internal affairs investigation, and a review of the reported events has begun.
 
"After a preliminary review of the information gathered, a decision was made to reassign both officers involved in the reported incident to administrative duties effective immediately and pending the conclusion of the investigation.
 
"We cannot comment further on this open, ongoing investigation, or on any potential litigation."

    Nationwide (not just Miami) the police are getting completely out of hand and have this "power trip" dream they wish to live out. The police (in general) have been such a discriminatory group, in particluar to LGBT citizens. I don't know how they can sleep at night knowing that their entire paycheck comes from us taxpayers. The rest of us have to get out there with our jobs and do it right and fairly in order to get paid-not them. They can go to work in any condition and still get paid for it. It truly sickens me.

    Just watch, they'll let these PIGS get away with it. They'll let them retire on disability, so that they can collect taxpayer money as a "reward" for a job well done. But was it for a hand job, a rim job, or a blow job? : ) And I didn't use the term "pig" in the sense that cop haters usually use it. These guys are PIGS in the sense that Rush Limbaugh is a PIG. A fat little flacid, pot bellied piggie on an Oxycontin high. Hillbilly Heroin. How appropriate. LOL

    Dieter sounds like he's pissed because when he cruised/es the guys weren't looking at him. Altho what he does say is mostly true. I live in the gay mecca of Wilton Manors (Fort Lauderdale suburb) and I get discouraged when I talk to my friends and it seems that at least 50% of them are promiscuous. (You start to wonder, 'God, do people do ANYTHING in this town besides screw???) That's kind of a lot of the point of a bunch of gay men living together in an area of a town (be it Chelsea, Weho, Wilton Manors, etc). Oh yea, and some want to find boyfriends. There's lots of gays who are not sex fiends, but most of them don't live in the gay meccas. They live in the straight areas of town.

    Reassigned to administrative duties?!?! These are serious charges and merit serious action. They need to be SUSPENDED while the investigation develops and then they need to be FIRED. We should have zero tolerance for this kind of police misconduct. Whether it's focused towards gays or blacks or whomever else.

    Back in 1994-1996 I lived in Miami Beach on 13th and Michigan across the street from Flamingo Park. It was a run down slum of a park in 94 that was home to many homeless. As the transformation of South Beach took hold the homeless were beaten out of the park by the police. It was also a well known late night cruising spot that was a favorite spot for police to operate their late nite covert operation of arresting people for committing victimless "moral "crimes. You know the "moral" crime of having a consenting sexual encounter with another consenting adult in a dark public park (parked car,etc...) when the consenting parties are of the same sex (not a crime if consenting parties are of the opposite sex). Because the park is large it was necessary to traverse the park to get to Lincoln Road and all the shops restaurants and Idol's Gym. If you were a gay male you knew that when you had to cross thru the park there was a real possibilty that you would be harassed-you walked fast!

I guess that happens when your mom is Maggie Gallagher like me. in reality I am a straight homeless man who uses the library to get on a computer, in between raping little girls in the library restrooms, and such. My mom Maggie is so proud of me...after all I am the best sex my mom Maggie ever had!

    Another non story from a YEAR ago that advocate is just now reporting. all I got out of this is that the editorial staff of Advocate must consist solely of high school seniors trying to get extra credit for English class, and that gay men like these people are embarrassing...cruising the streets after hours, and making out like whores in public. Not that what the police did was right. but this issue would largely go away if these gay men would STOP acting like sex fiends, cruising streets at night for anonymous sex. get a room or take it home. every gay neighborhood I visit, is FULL of guys cruising each other up and down the streets, and in parks, and in alleyways.
