Immigration Reform Could Include Gays

Gutierrez 390x (Gutierrez.com) I Advocate.com

U.S. representative Luis Gutierrez of Chicago said Thursday that foreign-born partners of gay and lesbian Americans should have the same rights to citizenship as those of heterosexual Americans — and that he would fight to include that proposal in his immigration reform bill.

“The underlying part of any comprehensive immigration bill is family unity,” Gutierrez told the Chicago Tribune. “We need to speak more clearly and more articulately and more frequently that the LGBT community, and same-sex couples and their binational relationships, are part of families.”

Gutierrez is proposing that language from the Uniting American Families Act, which has more than 100 sponsors in the House and 20 in the Senate, be integrated into the comprehensive immigration reform bill he and others introduced in December.

However, the prospect for that bill, which has 97 cosponsors, is unclear in this reelection year, the Tribune reports.

We as gay people, although I would use queer for myself, had better start caring about immigration. Coalition building can make our movement go further, and please don't forget that there are immigrants who are gay, who theses laws effect. My one criticism of the mainstream gay movement is that it only truly represents "middle class white gay males" while men of color or other people with multiple oppressions (class, race, and gender) are left out of the analysis. I think as gays we will constantly be a step behind conservatives, because they do coalition building very well... look at prop 8 and how religious right organized in the distinct communities Black, Mormon, and Latino drawing connection over one issue. The religious right can see connections..... so should we.

Melvin: Check out this immigration page. It has all the information you need. Your friend may qualify for a visitor visa waiver depending the their country. No need for a lawyer. http://travel.state.gov/visa/temp/types/types_1262.html

Melvin: your friend should be able to enter the country for at least up to 90 days on a tourist visa. You should be able to find information on a US travel, consulate or immigration website. There should have be information for tourist, length of stays and so forth. Sometimes, people are able to stay longer than 3 months without a lot of extra paperwork depending on their country of origin. Just don't go to immigration and say, "I want my boyfriend to come here and stay," or they may get suspicious and assume it may become an extended stay situation. Sometimes, for an extended stay its a matter of showing the traveler has travel medical insurance and enough money to cover living expenses while they're here. But if it's 90 days, check out tourist visas, or entering as a tourist. Good luck.

Before any domestic partner laws happened, which still aren't federal, their argument was the government don't recognize same-gender relationships so a law allowing immigration wasn't appropriate. Now we have domestic partnerships and marriage and we're still being given the words "could" and "may" include language allowing it. I suppose us 2nd-class folk will just have to wait until our masters decide if we're worthy and it's fittin'.
