Marriage Foes Try to Block Broadcast, Again

Anti-marriage equality forces defending California's Proposition 8 in federal court reiterated their opposition on Monday to broadcasting the closing arguments in the trial, currently scheduled for June 16.

In a letter to U.S. district judge Vaughn R. Walker, attorney Charles J. Cooper wrote that allowing cameras in the courtroom would violate an earlier stay order by the U.S. Supreme Court, which in January blocked broadcast of trial proceedings as part of a pilot project previously approved by a judicial council of the ninth circuit court of appeals. The high court ruled that lower courts "did not follow appropriate procedures," including giving "appropriate public notice and an opportunity to comment" before allowing webcasts of the trial. Such a high-profile case, the court's majority ruled, was not suited for a pilot program. 

Cooper's letter is in response to a new request to broadcast closing arguments of Perry v. Schwarzenegger by a media coalition that includes CNN, the Associated Press, Fox News, and NBC News. The group argued in part that closing arguments "will solely consist of the arguments of counsel — and not witness testimony or evidence."   

"The concerns earlier reviewed by the Supreme Court should not preclude this opportunity to enhance the public's ability to witness the parties' respective closing arguments in this case," attorneys for the media coalition wrote in a Tuesday letter.

Cooper said that counsel could still possibly include videotaped depositions of expert witnesses during their closing arguments, however.

Video clips of some of those depositions are already widely available on the Internet, including those of two defense expert witnesses, Paul NathansonandKatherine Young, who did not ultimately testify in court.  

Prop. 8 backers have vigorously fought broadcasting of the trial, claiming cameras would lead to witness intimidation and, as Cooper wrote on Monday, would have "negative effects on some judges and attorneys, including distraction, grandstanding, and avoidance of unpopular decisions or positions."

    It is very simple. they don't want the world to see how fringe-like, extremist, and idiotic the bulwark of anti-gay marriage activists are. They want "expert witnesses" (aka, we've heard this before, George Rekkers)

    It should be open to all, and available on the web etc. To show the world that some parts of christianity are the curse of western civilization. Filled with absolutism, women second class, desires to control your bedroom while they are out cheating on their wives, often with another guy. Repeat after me - while there are so many good christians, the catholic church, and the southern evangelical christian churches - many of them............... Have been, and still are a curse on Humanity. Anyone want to wonder where the taliban and Bin Laden came from - go study our own religious extremists.

    Obviously, the anti-same sex marriage folks do not believe in Civil Rights and seem to think that Church and State should be the same. This nation was born a secular nation in the age of Reason and it should always remain thus. Obviously,too, the anti-same sex marriage folks are afraid of just how stupid and illogical that they will look on tv judging by what we have already seen not only in the transcripts but those that were placed on Youtube. They are so stupid that they do not know that they are also cutting their own throats--if gay people can not marry then we can divorce these same anti-marrige folks and that should be one of the first things done to them if they get their way.

    They talk about intimidation, but how do you think they get people to believe them and their lies in the first place? They create deceptions to intimidate and frighten people ( or sheeple ) to get support. This trial is historic and needs to be seen by everyone, they need to hear the testimony from the victims of prop 8 as well as the lies from the Mormons and prop 8 supporters. I am eagerly awaiting the verdict.

    I am strongly OPPOSED to gay marriage or anything resembling gay marriage, and I will strongly fight against any attempt to make gay marriage of gay civil unions legal. Unless, of course I have to give my name or state my beliefs publicly. In that case, never mind. I don't want those mean gays after ne. (that was sarcasm). It just goes to show you how far people will (or won't) go to defend their beliefs. I think about all the brave african-americans and their supporters who were beaten and risked their safety to fight for equal rights. Same thing with gays who risked similar for equal rights. Guess the anti-gay-marriage people don't hold their beliefs *that* strongly if they fear a slight backlash. Right?

    I think all court proceedings should be public record. Does anyone know if they are in transcribed form. I really don't see what difference it will make. I'm much more interested in the decision.

    Great idea. But since trial wasn't, this won't be either. At least it will advertise that they are due to happen.... in June.
