LGBT Youths Face Prison Abuses

In an article for The Nation, National Center for Lesbian Rights attorney Daniel Redman makes the case for incarcerated LGBT youths.

In the article, child welfare and juvenile justice consultant Marty Beyer, who received her Ph.D. in clinical/community psychology from Yale University,  is quoted explaining that problems for LGBT youths often begin long before incarceration. She states, "LGBT youth are more likely to be arrested than straight youth because they're more likely to be pushed out of their homes." Once arrested, LGBT inmates often are subjected to unnecessary pretrial detention, verbal and physical abuse from peers and guards, lockdown, attempts at antigay religious conversion, and in some cases even orchestrated attacks. One minor from the California system says, "A female staff member set up a bisexual youth and let straight guys into his room to beat him up. I woke up and saw blood on the walls and on the ground."

Redman cites multiple statistics to this end: "LGBT kids are often targeted for sexual assault. A 2009 Department of Justice report shows that across the country, LGBT youth are twelve times more likely than straight youth to report being sexually assaulted by a fellow inmate. In Louisiana alone, 10 percent of all youth — gay and straight — reported abuse by a staff member." He refers often to one 14-year-old transgendered girl, Krystal, who suffered attacks from fellow inmates daily and who was verbally abused after refusing sexual propositions from her prison guards.

Regarding Krystal, Redman also writes, "In her letter to the judge, the counselor mentioned in passing that Krystal had confided in her that she was probably transgender, and that she was in a romantic relationship with another boy at the facility. On the voicemail he left in response to the counselor's report, the judge openly laughed and called the recommendation a joke. He said that based on those facts, he would absolutely deny the request for a release hearing." Krystal also reported that some of her gay friends had been raped while in prison, one of whom required internal stitches due to the force of the attack.

Other figures are no less alarming: "While only 3-10 percent of Americans are lesbian, gay, bisexual or transgender, LGBT youth make up 15 percent of the prison population. Indeed, one-quarter of all LGBT youth are kicked out of their homes or run away. Compared to their heterosexual peers, incarcerated LGBT youth are twice as likely to report abuse at the hands of family members, homelessness or state-ordered foster placement. A shocking estimated 20-40 percent of homeless youth identify as LGBT."

A novel 2006 federal court decision in Hawaii deemed unconstitutional the "relentless campaign of violence, physical and sexual assault, imposed social isolation and near constant use of homophobic slurs" and implemented mandatory training for correctional staff. In the wake of this decision, other states have begun reform initiatives.

    We really need to help LGBTQQII youth more. I had a judge say to me once ,"Young man, if you think dressing as a woman is going to get you any sympathy in my courtroom, you are sorely mistaken sir." Just before she threw the book at me. My offense? I was rear-ended on the freeway, and the Highway Patrol decided to give me the ticket instead of the person who slammed into me (while I was at a stop because of a traffic backup), because he could not believe that I was rear ended. He cited me for insurance fraud, claiming that I must have swooped in and slammed on my brakes. BTW the driver who rear ended me left the scene, and I called the police. That is just one nightmare of being transgender and dealing with police or courts. The office would rather believe a hit and run driver, than me who was completely innocent.     People should be taking this kind of information to the Christian organizations and see what they say. We are so worried about the gays in Malawi and Uganda, but look what we have at our doorstep. (BTW, one commentator on the recent Anita Bryant article seemed disgusted, judging by number of comments, that more people were more interested in her article than the LGBT youth [ironically he is not commenting here]. Most of the comments on her article were clever barbs, but how can one make a clever quip about this? You just can't.)

    This is a wake up call to everyone in the LGBT community. I personally have experienced vicious homophobia from the police, and can only imagine what a nightmare it is for anyone who is LGBT and placed in prison. To hear that a judge openly laughed after hearing that a Transgender prisoner was being violently abused is disturbing to say the least. Institutionalized homophobia is a reality that far too many people have to live with and are unable to fight on their own. This article is heartbreaking and scary, and I hope it makes people aware of how important it is that we stand up for our rights and always fight back against abuse, violence, and oppression.

    The mainstream, and even the gaystream media usually only ever focus on marriage in the fight for LGBT equality, but this is the first time I've seen anything on this that I didn't have to go searching for myself. Sometimes I think the 'movement's' priorities are so ass backwards. Some of us are still fighting for our very survival while most people think those days are behind us. I've dealt with my share of homophobic assholes but thankfully I've never been outright attacked. Others aren't so lucky, and marriage won't stop the violence. It's an out dated and useless institution to begin with. What we really need to wonder about is why this is the only institution that makes a legally valid family in the first place.

    And all the "normal" gays do is plead Obama and his cronies to give them marriage so they can go ahead and hide in the suburbs to live the white life they've always wanted but weren't able to do because they're gay.
