Brewer: We'll Appeal Immigration Ruling

JAN BREWER ALT 01 X390 (GETTY) | ADVOCATE.COM

The Republican governor of Arizona, Jan Brewer, has vowed to appeal a federal court ruling that blocked key provisions of her state's new immigration law.

Bloomberg reports that Brewer wants to appeal the decision made Wednesday by a U.S. district judge in Phoenix. Susan Bolton ruled that Arizona can’t mandate that police make a “reasonable attempt” to determine whether a person is legally in the United States and then detain him or her if there is “suspicion” that he or she isn’t. Nor can it be required that immigrants carry their documentation with them at all times.

A legal professor told Bloomberg that Brewer would have a difficult time being heard by U.S. court of appeals for the ninth circuit in San Francisco. “The key provisions of the Arizona law were unprecedented. It’s a sound ruling," Temple University law professor Peter Spiro told Bloomberg.

As a non-American I look from the outside and this issue comes across as a very scary type of legislation. It hints at those movies we've seen and the incidents we've heard of where heavy-handed police, expressing themselves arrogantly, have taken their "powers" and misused them. This type of legislation with its words of "reasonable suspicion" etc, etc, is giving a power to police that I don't think they need. And it again shows the Republican weakness for asserting dominance over people, and creating an environment of fear, intimidation and superiority that they seem so good at. I'm not saying illegal immigrants shouldn't be treated as law breakers, but it's how they'll be treated that is a concern. And for so long the authorities have done nothing about this problem anyway. They must therefore take a portion of the blame for this problem escalating to where it is today, and exercise greater caution and benevolence. I pray the courts will uphold their ruling.

"At the same time, I know that Churches are struggling with falling congregation numbers all across the country; and would love to have those Hispanics that are coming to this country in droves illegally" -- You make a valid point. But it is my experience that the majority of Mexican Catholics "tend" to be open to gay marriage, yet the protestant ones are more vigorously opposed to anything gay. And it is the protestant ones that are more active in recruiting illegals (mormons, jehovahs witnesses and other cults). However, it is an interesting point to make that these "evangelicals" want immigration "reform" but they want gay couples excluded at all costs. This is the enigma I don't understand. Why do gays want to support illegals who are mostly supported and recruited by those who call gays "the detestible beast of satan" (jehovah's witnesses) changing their status to "legal" and one day becomes citizens so they can vote against gays. Liberal hypocrisy strikes again.

@ Charles... Oh, I have read the Bible, quite extensively. I even studied it in classes when in college. I asked for specific verses because I was wanting to know which ones Geof thinks support illegal immigration. Could it be his apparent reluctance to do so is because he just doesn't know and is just making assumptions based on what others have said? Keep in mind the Bible was misused in the past to justify slavery (reasons given range from blacks were cursed to slavery by Noah's condemnation of his son Ham who is believed by many to have been the ancestor of black skinned people to the improper use of the word slavery when indentured servitude would have been more appropriate). I'm really curious to see how he is doing the same with illegal immigration, assuming he can. Mayhap you would be able to contibute, assuming you can? And yes, I'm a member of the GLBT community.

I'm torn on this issue. I feel it's wrong to turn our backs on these people, who only want a better life. At the same time, I know that Churches are struggling with falling congregation numbers all across the country; and would love to have those Hispanics that are coming to this country in droves illegally, because the overwhelming majority are Catholic and would help their coffers greatly. That would be to the detriment of the gay community. It's wrong to NOT help; but if we help, then we (the LGBT community) will be made to suffer for it.

I find the comments on this issue very interesting and informative. The only thing that I wish to contribute, is to Jeannie from Tempe. If you have to ask for specific verses from the bible, then it is quite apparent that you have never read the bible. It's an interesting piece of fiction. You should give it a read. You can't hope to understand the enemy, unless you educate yourself about them. BTW, are you even a member of the LGBT community?

@ Frank, just get to the point. Stop trying to focus on me personally. Let me get straight to the point: your arguments that those that supported the law are members of the KKK is stupid and ridiculous. I've read the article and is not convincing. But here is the crux of the matter: what does this asinine assertion have to do with illegal immigrants cutting in front of the line, getting jobs through fraud, getting entitlements from the government and having the tax payer pay for them? I am baffled, but not surprised, how you want to prop up any excuse in desperation to discredit the AZ law. It is called hate mongering, and you do it pretty well coming from somebody that denounces it. Now the best arguments against SB 1070 are much more simpler and more credible: there is no need to have a state law since there is federal law that police can enforce; this law burdens the person with proving that is not an illegal. These are the strongest arguments, yours are pretty weak I'm afraid.

@pepa I don't know if you know this but, your arguments make no sense. Probably that's how they roll at the tea party anyway and you are used to that by now. The title of the article is " Hate Group Lawyer Drafted Arizona’s Anti-Immigrant Law". It doesn't get any clearer than that. And again, the link ----- http://www.splcenter.org/blog/2010/04/28/hate-group-lawyer-drafted-arizona-anti-immigrant-law/ ---- You can repeat your arguments over and over, but you can't beat logic.

"your choosing the word "savages" to describe the people of Uganda speaks volumes" -- It is an appropriate term for people who want to round up and kill gays. Please read all the relevant articles on this site alone regarding Uganda. You will find that the people who are advocating for the kill the gays bill are in fact not normal in their way of thinking so as to accomplish their horrific agenda of a modern day genocide. The Nazis have been called savages for doing the same thing. So today, being that we are talking about the AZ law, of course many libs like you will do an about face (as in questioning the accepted use for the term "savages" on Ugandans who want to kill gays) and show your hypocritical side. What a shame.

Again, you libs are so hypocritical. I bet you wouldn't have the same views if Uganda was next door to us instead of Mexico. For those that want open border and amnesty for all, why not let all the savages from Uganda come come right in too. Why should we deny them the right to come to our country at their whim and choosing and import their totalitarian, anti-gay, anti-western, ideology and imposing it on us. Maybe David Bahati and Martin Ssempa can apply for citizenship too, maybe even run for congress one day. Wouldn't that be wonderful you gay libs?
