Marriage Equality Win in Mexico

The marriages of same-sex couples performed in Mexico City must be recognized by all Mexican states, the country's supreme court ruled Tuesday.

Though Mexico's 31 states now must recognize such unions from Mexico City, none are required to sanction gay marriages performed within their locales.

The court ruled last week that the Mexico City law permitting marriage rights for same-sex couples is constitutional, rejecting an appeal by federal prosecutors, who argued that it violated mandates to protect the family. 

In a 9-2 vote, the supreme court found that states are obligated to honor legal contracts formed elsewhere in the country, the Associated Press reports. 

Mexico City legalized gay marriage in March, and it includes the right for same-sex couples to adopt children.

    For Deke: You are right there is some regulation in the state of Coahuila, but it is only domestic partnership not a fully recongnized legal marriage like the one now available in Mexico City. Let's see what the Supreme Court decides this forcoming week on adoption rights. Keep fingers crossed!

    I had the pleasure to marry my Mexican partner in Mexico City on May 22nd of this year. It was very special for me since being a Canadian I have had the right to be married my own country for some time now. It was great to see his friends experience their firt gay wedding. I could not have had a nicer experience for our wedding. Congratulations Mexico!

    This is an ocassion for all LGBT people to rejoice and celebrate. But keep in mind something very important, the goverment that pushed forward this new legislation comes from the left side of the Mexican political spectrum, don´t forget it specially right now that most of our country is in a sort of a tourmoil, Mexico City is becoming some sort of oasis for democratic freedoms, better social services and room for everyone! I'm happy and proud to be a "Chilango" and for having voted for our Mayor. Sadly but where else in this country can one have such opportunities? ¡Viva la Ciudad de México y su gobierno! ¡Viva la Suprema Corte de Justicia that in this particular ocassion beat the conservatists! This is good for the whole of the society.

    @ J.B. I know, little by little bigotry is losing the battle! There is no minimum residency time, you just have to proof you are resident of the city with a valid document (electric bill, bank statement, etc.), although this requirement does not apply if both persons are foreigners, so people from outside Mexico can actually come to Mexico City and get married, which is a very good excuse to visit.

    Oscar, thanks for the info. I agree that it's a huge accomplishment even if there's a residency requirement. The wall of bigotry was just hit with a wrecking ball. How long must one be a resident to apply for a marriage license?

    @ J.B.: Although this is a great victory, unfortunately its reach is not as wide. This ruling forces other states to recognize marriages performed in the Federal District (DF, Mexico City) but does not force other states to allow marriages to happen in their territory. In addition, in order to get married in Mexico City (for anybody, not only same-sex couples) at least one person in the couple has to be a resident of the city, which won't allow couples living in other states to travel to the city just to get married. This is a great step, but the fight continues!
