Advocacy Groups Wary of Wyo. Lawsuit

A federal suit filed by Cheyenne residents David Shupe-Roderick (pictured) and Ryan W. Dupree challenging Wyoming's ban on marriage equality could jeopardize inroads made with state legislators, local gay groups say. 

The couple, who filed the suit earlier this month, "do not understand the dynamics of this and are making a rash decision, and it’s going to impact us in the long run," Wyoming Equality board member Tim Reid told theCasper Star-Tribune.

Reid and others said they were worried that the lawsuit spectacle might damage their ongoing work with gay rights initiatives in the state, including antidiscrimination laws and adoption rights for same-sex couples. 

Shupe-Roderick, a 25-year-old convicted felon who served four years in state prison for stealing a rental car, has a litigious history, having filed five lawsuits over the past three years, from allegations of sexual misconduct at the hands of a prison guard to breach of conduct by a prospective business client.

Bob Warburton, acting president of the Wyoming Stonewall Democrats, called the lawsuit "a sideshow."

    A novice filing a lawsuit alleging constitutional principals in a backward state court is a sure loser. And when you lose, you set president which may be binding on future litigants. Every loss in state court makes it more difficult for an eventual win. So "Dufus" filing a lawsuit because he feels wronged when he will lose does not help the LGBT cause for equality, it hurts it.

    The problem with advocacy groups is that they sometimes think they've got the right to call the shots on when lawsuits are filed. Fact is any individual or couple in America has the right to file whenever they feel they've been wronged. Perhaps if all of us had stopped sending our money to do nothing organizations, and instead used it to clog the court system with our individual lawsuits, we might be farther ahead by now. I've been hearing "it's not the right time" from politicians and community leaders for decades now. I'm really sick of it.

    I hope the couple that is filing this lawsuit reads this: You should never go into a court of law without a skilled attorney respresenting you! Even if you are an attorney yourself, it is still very risky to represent yourself. The WY Attorney General will probably be defending the state and he/she is definitely skilled enough as the state's top lawyer to make any legitimate argument may by a non-attorney sound like jibberish. Equality Wyoming and/or Lambda Legal should step in as legal counsel for the plaintiffs.

    I agree with the Wyoming activists. We don't have to jump through a hoop just because someone is holding it up. I think opponents of Gay Rights would love to go to court against this person because he is going to get zero credibility and empathy from a judge or jury.

    And really, why shouldn't he sue about this matter. Everyone should sue, to hell with the gay groups who say it might be detrimental...what the hell are they doing exactly to fight the battle? I say sue, sue and sue some more because the only way gays are going to acheive full equality is to win it in the courts and not let up until they do.

    So I get that the guy has a record. Why don't they just say what they mean? Dude, you file frivolous lawsuits so no one is going to believe you? Okay. I get that. Otherwise, screw it. I'm tired of taking what I can get. We are talking about RIGHTS, not privileges. We aren't children and the legislation (state or federal) isn't our mommy telling us we better make our bed if we want our allowance. A Right: something to which a person has a just claim (mirriam-webster.com/dictionary/right(n). That means it's ours. We own it regardless of what they say. Can we stop groveling already, stop trying to appease these liars who are just putting us off? Call them on it! Screw this, "can't you just play nice, wait, we're getting you the best we can right now?" We don't have to wage a war, just vote and get active in your community. *this does not mean don your pink lace lingerie and parade around town with a flag. DON'T HATE, ADVOCATE!

    "has a litigious history" Isn't that the way of the world down in the states? The Westboro clan sue people all the time. Hell, if your coffee (which you full well know to be hot) burns you then what the hell...let's sue. The courts are bogged down with frivolous lawsuits all the time. Wasn't there even one awhile ago where a judge sued a drycleaners for having lost his pants after he had forgotten about them for months? It's a little ridiculous to single this person out for doing what seems to come naturally in todays day and age.

    Ah, the "I-know-better-than-you" people are at it again. Maybe if these well-paid "activists" came out of their ivory towers every now and then and told we the people what they are doing, people would not be taking matters into their own hands. I also like how the Advocate is helping assassinate the character of one of the people who filed the suit. Gee, I wonder where that information came from...
