HIV-Positive Man Arrested for Having Unprotected Sex

A Raleigh, N.C., man has been charged with a public health violation for allegedly having unprotected sex and not revealing to his partner that he has HIV, reports local station WTVD 11.

If convicted, John Conway Hart, 27, could face up to four months in jail and be subjected to a medical quarantine.

While she declined to comment specifically on this case, Wake County health director Sue Lynn Ledford said she preferred education to prosecution. “This is an extreme last measure for us, an extreme last measure for us,” she explained. “This is the very last thing that we would look to do and we would, we would try everything else first.”

A sexual partner of Hart’s went to police after finding out after the fact about Hart’s HIV status.

I think this is a sad situation and I do believe the whole community should become more education about the disease and screening for it. I hear everybody saying Oh this and Oh that, but so many people never take the time to just ask a partner do they have any STD's when they feel they have a pretty face or a big butt at times. Sex is not just a good time these days, we have to protect ourselves. I do agree however that posting this mans picture is a violation of his privacy titled in HIPPA. Both mens pictures should be here if they desire to point a finger. We as a community need to become proactive and not reactively dodging the bullet. If we don't change the way will live we will never stop this disease from pasting from generation to generation. People dont like to talk about it but we need to talk about HIV and AIDS and how it really affects the community. I can not judge this man but God can and I pray that all the criticism does not cause this man to take his own life.

@dee...um so i understand you say why the other person didnt use condoms and thats understood but it still dont justify the fact that if a person knows they have HIV and dont tell the person they have sex with that that is attempted murder cause u know what the disease will do to you. If a person did that to you with the knowledge that they had it, how would you feel? this is not the clap that you can just take a shot to get rid of this is serious. I believe that a HIV+ should be way more responsible and he is lucky that they dont treat HIV+ people like they treat sex offenders.

Since when have you been able to know the intentions of another person? You know what he has going on inside his head at all times? @Dee, if you infect a person with HIV due to the fact that you refused to tell them you yourself were infected, why wouldn't that be attempted murder? People die from HIV and AIDS. It's not like he is giving people the clap or crabs. He is potentially killing them. So tell me again why it isn't attempted murder?

Anybody defending this guy is a complete IDIOT, this guy knows he has HIV and spreading it countless women. HIV and FLU really, how dumb can you be. If someone gave your mom, sister, aunt or a female you knew the flu or HIV which would you be upset about. I don't care if the guy is black, white, yellow or green, he needs to be locked up. And to the women that are defending him why don't you sleep with him.
