The Next DADT Hurdles

Now that the Senate Armed Services Committee has attached DADT repeal to the defense authorization bill, the next trick will be gaining approval of the full Senate.

Although “don’t ask, don’t tell” repeal advocates were heartened last week by votes that attached a repeal measure to the 2011 National Defense Authorization Act, they are gearing up for the next battle — the Senate floor.

The full House voted to approve the defense authorization bill with repeal, but in the Senate, the measure was attached in the Senate Armed Services Committee and awaits approval by the entire chamber. Advocates say those who oppose ending the gay ban could filibuster the entire bill — which would keep it from being considered on the Senate floor and require 60 votes to overcome — or once the bill is being debated on the Senate floor, they could offer amendments that either strip out the repeal language or dilute it.

“Clearly, there are a lot of unknowns,” said Fred Sainz, vice president of communications at the Human Rights Campaign. “This is a moment by moment situation where we will be living with our hearts in our throats until the president signs the bill into law.”

Sen. John McCain of Arizona, for one, has said he would support a filibuster of the bill, but Aubrey Sarvis, executive director of Servicemembers Legal Defense Network, doubted that mounting a filibuster of the whole bill based on the repeal provision alone would have broad appeal even among Republicans.

Sarvis explained that blocking funding for the troops overseas due to the potentiality that gays and lesbians might be allowed to serve openly in the military would not sit well with most voters.

“That is very tough to explain back home,” he said. “Providing funding levels for the nation’s security is one of Congress’s fundamental responsibilities to the American people.”

    What about those of US that were discharged because of DADT, HONORABLY, that are now too old to return to active duty to hit AT LEAST our 20 year mark we were shooting for? I was in 17 years and a month!! Am I going to get some type of back pay from the date of my discharge? I will be the first one to sue the gov't for discrimination and parading my sexuality on my DD-214, also!!! There is a numerical code and a written description as to the reason for discharge. "Oh, I see. I can't tell YOU, but when YOU kick me to the curb YOU can parade MY sexuality FOR ME ???" Isn't that ILLEGAL everywhere else in this country?? What's the FIRST thing ANY potential empoyer asks for when applying for a job outside the military?? "Got your DD-214?" I'm pissed, and am ready to go to "war" against the very country I served, honorabally.... IN COURT !

    NOW the Repubs are boxed into a corner... Filibuster the whole bill and anger their constituents; or just object to the part repealing DADT and look like hypocrites out of step with the mainstream of American thought. Are you listening, John McCain?

    This is something to consider How about a defense only budget? There are a lot of gays in the military who would only be too happy to defend our country,or individuals from agression from outside enemies or internal

    If there is a threat of filibuster, carry it live so the 78% of Americans supporting repeal can see who is wasting money and delaying the inevitable repeal of DADT.

    Instead of living with their "hearts in their throats," HRC staff ought to be furiously lobbying U.S. Senators to make sure they have the 51 votes to get the legislation passed, AND they should stop going to cocktail parties at the WH until our "fierce advocate" actually picks up the phone and helps us get any missing Democrat votes for repeal of DADT. After all, there are 59 Democrat Senators and the two Republican Senators from Maine have indicated their support of repeal (one even voted for it in Committee)--that should give us a filibuster-proof Senate.

    75% of Americans polled want the unconstitutional DADT repealed now and no more of our tax dollars wasted funding it and weakening our military. The Republicans will have a tough time in the November election if they defy the very people who pay their salaries and family benefits.
