Connecticut Marriage Ruling Shifts Focus to California, Prop. 8

While LGBT citizens and supporters were rejoicing at the Connecticut supreme court’s Friday decision to legalize same-sex marriage, others were already weighing what effect the ruling might have on this year’s marriage amendment battles in California, Arizona, and Florida as well as the presidential election.

While LGBT citizens and supporters were rejoicing at the Connecticut supreme court’s Friday decision to legalize same-sex marriage, others were already weighing what effect the ruling might have on this year’s marriage amendment battles in California, Arizona, and Florida as well as the presidential election.

Kate Kendell, executive director of the National Center for Lesbian Rights, thinks the Connecticut decision is a victory on the path toward “crushing” Proposition 8, a measure that would -- if passed -- eliminate the right to same-sex marriage in California.

“What’s happening in Connecticut just helps show how offensive this backward Proposition 8 is,” Kendell said. “We need to defeat it, once and for all. It’s time for us to see our relationships accorded the same dignity and protection as everybody.”

The decision makes one thing clear, according to the LGBT activist: more and more policy makers, elected officials, and average Americans do not want their gay and lesbian neighbors, coworkers, and family members to be excluded from full equality.

Hunter College political science professor Kenneth Sherrill shared Kendell’s perspective that the ruling would reinforce the California Supreme Court's decision and potentially cause voters to question the wisdom of Prop 8.

“It now becomes easier to think that California [voters] will follow Connecticut’s lead as well as other states,” Sherrill asserted.

Sherrill said the Connecticut decision coming right on the heels of the California decision might indeed be announcing a new trend that other states will follow.

“It’s a brilliant decision and a great positive example for the nation,” he said of the fact that the court found that marriage equality is constitutionally required.

Though the decision constitutes major progress in the quest for equal civil rights for LGBT individuals, Sherrill also noted that a lot of people are still virulently opposed to same-sex marriages. “We have won in a court of law,” he explained, “but we now have to win public opinion, and public opinion seems even harder because it’s not rationally based -- it relies on emotions.”

In fact, several polls in the past couple of weeks have found that the court of public opinion is still wavering on gay marriage. In the wake of a successful ad campaign by opponents of marriage equality, internal polling by Equality California, the organization working to defeat the marriage ban, found that 47% of California voters said they favored the initiative while 43% planned to vote against it.

Sherrill anticipated that the religious right would try to use Connecticut to scare people, but he still concluded it was a net plus for LGBT people. “I believe we’re on stronger footing on using this decision than they are, ” Sherrill said, referring to social conservatives.

    I may be wrong, but I got the feeling that the 'blessing in disguise' from the recent financial meltdown in the United States will be the defeat of these marriage amendments keyed for several states. Once again, people are coming around and saying "it's the economy, stupid!"

    If Obama was trying to stay neutral, he wouldn't have Yes on 8 advocates leading his "Faith Tours". Obama has repeatedly, and consistenly, allied himself with homophobes who campaign against our civil rights. Anyone who thinks he's going to have a sudden change of behavior after he's elected, are fooling themselves. When he starts running for re-election on 5 Nov, is the battle cry going to be that he'll pay us some attention in 2013?

    "I live in the world of professional politics, and you live in the world of adolescent tantrum!" I think this quote, from The West Wing, says it best. Obama can't come out overtly against prop 8, get over it. It would hurt him substantially, and energize the Republican base. Hillary wouldn't be crazy enough to come out against Prop 8 either. At least Obama is avoiding the issue. He could be doing much worse. He could do what Kerry did in Massachusetts and support a gay marriage ban, but he isn't doing that.

    Politics is the art of the possible. Thus I agree with Gunnar. If Obama speaks as loudly as I would like on the issue of Marriage Equality, then McCain will use this to win the White House for himself. That would spell dissaster for Marriage Equality and related issues. But if Obama gains office, then pressure can be applied to steer him in the direction of supporting equality for all. There are no garantees, but I will accept Obama's silence as the price that must be paid to get him into office. After that ... all bets are off.

Of course, anyone who is capable of reading between the lines a little bit will know from past Obama interviews that he is really in favor of gay marriage. But the most important thing for him right now is, and should be, to get into office. That's why he has adopted a position that is basically in favor of full equal rights under a different heading than marriage. Of course it's not the ideal solution, but would you rather have him state his opinion openly and that way alienate a lot of anti-gay marriage voters? He might as well just hand McCain the presidency.

    There is sometimes an enormous gulf between what the courts decide and what the voters decide. The court has to rule on the rule of law; the voters vote their prejudices and emotions. It will be interesting to see how the voters act in California, Florida and Arizona. Of all the states that have held anti-same sex marriage amendments, only Arizona voted it down. And now Arizona is voting again. Imagine what it would be like to have the validity of your marriage come up for a vote every couple of years. It is interersting watching this play out.
