A judge has ruled that a lesbian couple married in Massachusetts will not be allowed to get a divorce in Pennsylvania, reports The Boston Herald.
Carole Kern and Robin Taney's married in Massachusetts in 2009 because same-sex marriage is not legal in their home state of Pennsylvania. When the couple decided to divorce, they found that while Massachusetts has no residency requirement to marry, the state has a one year residency requirement to divorce.
The two then filed for divorce in Pennsylvania, where a judge on Friday refused to divorce the couple. Berks County Judge Scott Lash wrote in his ruling: "Relief under the divorce code can only be obtained by parties who are recognized to be married."
