The justices will meet privately this week to decide whether they will hear the former Kentucky clerk's latest appeal.
The justices will meet on Friday to consider whether to grant Kim Davis a hearing on her challenge to marriage equality.
“It is not a violation of these canons for a judge to publicly refrain from performing a wedding ceremony based upon a sincerely held religious belief,” the Texas Supreme Court ruled.
The attack has not been charged as a hate crime, despite the couple's account that they were targeted because they are gay.
