Judge: No Stay in DADT Ruling

U.S. district judge Virginia A. Phillips has denied a request by the Justice Department to stay her ruling against any further enforcement of the “don’t ask, don’t tell” policy.

Phillips, who indicated during a Monday court hearing that she would reject the government’s attempt to keep the policy in place pending its appeal in the case Log Cabin Republicans v. United States of America, wrote in her Tuesday order that the Justice Department’s arguments in favor of a stay were “unpersuasive” and short on specifics of immediate harm.

“To the extent Defendants now argue that stopping discharge under [don’t ask, don’t tell] will harm military readiness and unit cohesion, they had the chance to introduce evidence to that effect at trial,” Phillips wrote. “Defendants did not do so. The evidence they belatedly present now does not meet their burden to obtain a stay."

In the Monday hearing, assistant U.S. attorney Paul G. Freeborne had asked Phillips for a five-day stay of her injunction so that the government can pursue an appeal with the U.S. court of appeals for the ninth circuit. The Justice Department has not yet filed an appeal of Phillips’s stay, though attorneys involved in the lawsuit predicted that the ninth circuit would rule on the matter this week or early next week. 

News of Phillips’s ruling came as little surprise, and her injunction against “don’t ask, don’t tell” has quickly altered the military landscape. On Tuesday a Pentagon spokeswoman said the Defense Department has suspended enforcement of DADT and ordered military recruiters to accept applications from gays seeking to serve in the armed forces.

Several gay service members discharged under DADT, including a Log Cabin Republicans chapter vice president in San Diego, visited military recruiting offices Tuesday seeking to reenlist or to be reinstated. Advocacy groups continue to warn current gay service members against coming out, however, should a higher court overturn Judge Phillips’s order.

In a statement, Log Cabin Republicans executive director R. Clarke Cooper said of the ruling, “It is vital that as a nation we uphold the fundamental constitutional rights of all soldiers, sailors, airmen, marines and coast guardsmen. With recruiters accepting gay and lesbian applicants and a week having passed without incident, it is clear that our military is well-equipped to adapt to open service, and eager to get on with the work of defending our freedom.”

During the Monday hearing, Phillips said the injunction she ordered does not preclude the government from carrying on any training or education efforts for service members nor does it prevent completion of a Pentagon Working Group study on DADT repeal due in December. "The implementation of new regulations can and should go forward," Phillips said. "That’s not prohibited by the court's order."

    oh yes virginia...there is a santa and HER name is also VIRGINIA!! yay for her and others such as myself who look at the military and say, "the burden of proof is on YOU". PROVE that this person "will" disrupt unit cohesion...PROVE this person will harm mission readiness...PROVE to the courts and the world, that WE will "create" a disruption in unit morality...yup. the the most amusing thing about it all is NO military can "prove" anything when confronted with the simple questions all the courts have been asking them, when the burden lay on their table to be shown the court. i wont say i am disappointed in barack taking a, "wait and see" stand on this. i WILL be very p***d if he takes credit for DADT being completely abolished, and new guidelines written to incorporate open servicemembers into the ranks. when DADT is abolished and barack takes his pen and signs the paper that requires his signature as sitting president, then i will say, "thank you for your signature, mr. president"

    To those who are critical of Obama for fighting this ruling, for what it's worth, you can take heart in the fact that he's not fighting it very well. Remember Rekers in Florida with the gay adoptions case and the pro-Prop 8 side in California? Someone, like McCain, truly opposed to this ruling would buy an "expert" with evidence in their favor and present someone who will claim to be harmed by it. Obama's doing none of these things. He's probably having the Justice Dept. argue their case with the intention of losing.

    I guess we have to thank the Log Cabin Republicans for bringing the lawsuit since Obama and the Democrats have lost all credibility on LGBT issues. POTUS Obama knows full well that there will be no bipartisan repeal of DADT or DOMA.

    Mike Almy informs on the Advocate, Oct. 16: "The European Court of Human Rights ordered the British military to abolish its policy of discrimination against gays and lesbians. Instead of appealing the decision or requesting a delay, the British Ministry of Defense immediately complied with the court’s ruling and virtually overnight changed its policy to allow gays and lesbians to serve openly. It issued a policy of zero-tolerance of discrimination based upon sexual orientation and established a code of social conduct, applicable to all personnel, that is still in effect today." What a contrast to the US where gays and lesbians clearly are unwanted in the military. What a challenge to students of sociology to find out why! One cue: study the infestation of the military by religious zealots like evangelical "pastors" and their ilk. To them the presence of successful gay and lesbian personnel is a big threat. Research and inform us!

    For those legal experts who contend that the President is compelled to appeal the DADT ruling, I have a question. Do they also contend that the President is compelled to seek a stay of the ruling? Do they contend that the President is compelled to immediately appeal the ruling itself? The Pentagon also "urged" gay and lesbian service members that they could face discharge if the ruling was reversed. They did not indicate that any incident against gay and Lesbian service members would be dealt with harshly. They didn't say such incidents would be dealt with at all. As a result their contention that they are worried about unit cohesion seems dubious. If they were really worried about unit cohesion, wouldn't they have addressed this issue? They just don't want gays and lesbians and are willing to say anything, even under oath to prevent it.
