The attorneys representing a teenage boy accused of slaying his gay classmate wants the judge overseeing his upcoming trial to recuse himself.
The attorneys for 16-year-old Brandon McInerney said Monday that Judge Charles Campbell will not be fair in overseeing the case. The recuse motion instantly stops the trial from moving forward until the issue is resolved, according to the Ventura County Star. Campbell has five days to respond to the allegations.
Prosecutor Maeve Fox said the motion to recuse Campbell was "a
ploy...ridiculous, and disgraceful."
McInerney is accused of murdering Lawrence King at E.O. Green Junior High School in Oxnard, Calif., in February 2008.
