The ninth circuit court of appeals will decide soon whether to revisit its
decision to deny gay rights activists access to internal communications among leaders of the pro-Proposition 8 effort.
According to a document from the court (PDF) filed Wednesday, one judge out of the 27 who serve on the court called for a review. A three-judge panel of the court ruled December 11 that Yes on 8 was not required to release its communications. If reviewed, the matter would go before a panel of 11 judges.
Each side was asked to make its arguments in writing by December 24.
