Aspiring singer Ian Benardo has launched a third lawsuit against the producers of American Idol for discrimination, claiming they "exploited" him by asking him to "gay it up" when he auditioned in 2006.
Benardo originally sued the show for $300 million, but he reduced that amount to $100 million when he refiled legal papers in September 2010.
That suit was dismissed, but according to TMZ, he filed again on Friday, this time asking for just $5 million in damages.
Benardo appeared on the reality show's season 9 finale, snatching the mike from comedian Dane Cook and leveling harsh accusations against Simon Cowell. He claimed Fox execs invited him to the show and urged him to perform the stunt.
