NOM on Reports Prop. 8 Judge Is Gay

National Organization for Marriage executive director Brian Brown has responded to the San Francisco Chronicle’s column reporting that federal judge Vaughn Walker, who is presiding over the Prop. 8 case,  is gay, attacking the judge not for his sexual orientation but for being biased. 

A column in Sunday’s Chronicle called Walker’s sexual orientation the “biggest open secret in the landmark trial over same-sex marriage." Brown, in a blog post on NOM's website, says he has no idea if the article is true, but says Walker has taken a one-sided stance throughout the trial.

Reads Brown's statement: "In a story this Sunday, the San Francisco Chronicle reported that Prop 8 Judge Vaughn Walker is gay and called his orientation 'the biggest open secret in the landmark trial over same-sex marriage.' We have no idea whether the report is true or not. But we do know one really big important fact about Judge Walker: He’s been an amazingly biased and one-sided force throughout this trial, far more akin to an activist than a neutral referee. That’s no secret at all. Protect Marriage, the defendants in this case, are effectively being held hostage by Judge Walker and cannot really comment. ...

"Judge Walker’s bias has been so extreme, he’s earned a rare judicial 'twofer.' Key elements of his 'fishing expedition' rulings were already reversed by the Ninth Circuit Court of Appeals (notably one of the most liberal in the nation) and the Supreme Court had to step in to block his illegal attempt to broadcast the trial. It is highly unusual for a higher court to have to intercede in a trial judge’s handling of a trial while it is going on — yet Walker has had that 'distinction' twice in the same case — and we’re not yet even at closing arguments. There’s only one saving grace to Judge Walker’s bias. It’s so big, and so obvious, not only the American public but the Supreme Court itself is already aware we have bias in the trial judge presiding."

    @ZAPP0777: "GAYS ARE TRYING TO MOCK GOD AND GOD WILL REPAY THIS INSOLANCE" When God comes down and starts issuing marriage licenses, get back to me. Until then, marriage is a government entity. With government issuance of a license and government granting rights to those licensees, it's a civil rights issue. Keep God in your church and out of our government.

    It's true that many Republicans, conservatives, and religious zealots use dirty tricks because there it often no merit to their arguments. And it may also be true that same-sex marriage is inevitable. But to answer one commenter's question why bother fighting this, the answer is, the haters need a scape-goat and we're it. We've been their scapegoat for how many centuries because the shame that we carry makes us easy targets. We don't stand up for ourselves because we're afraid of persecutioin, loosing our jobs, having our careers destroyed, our families ruined, and we fear being beaten and killed. Little by little, lgbt people are owning their identities and learning to be proud, casting aside the shame that has previously kept us quiet and allowed other to scapegoat us. That's the reason we're still the targets. It's also the reason why it's so important to do the work, learn to love ourselves, and stand up for ourselves as proud lgbt Americans.

    Richard of Indianapolis, Judge Walker was involved in the case that denied the "Gay" Olympics title to gays. However, he was not a judge then, he was the plaintiff attorney representing the US Olympic Committee. He was not in the closet (but I suppose most straight people involved in this case did not know his orientation), so he was not "outed". He has been on the Bench for 20 years, having first been nominated by Ronald Reagan and then George H.W. Bush.

    Zappo the Fag Smiter. Great Biblical Title Huh! I've said it before and I'll say it again. The Bible says everything from "Love Thy Neighbor" to "kill your disrespectful children" to "God made the Heavens and the Earth in 7 Days" and was SHE tired! My favorite quote to throw at hysterical Bible thumpers is Ezekiel 23:20 "THERE SHE LUSTED AFTER HER LOVERS WHOSE GENITALS WERE LIKE THOSE OF DONKEYS AND WHOSE EMISSIONS WERE LIKE THAT OF HORSES"! I'm all for love thy neighbor which is the only true commandment handed down empirically from Jesus Christ but most of the Bible is crap used by hateful sheep to persecute anyone and everyone that they choose. Keep your Bible hysteria out of my Bedroom...AND in case you were wondering about the Rapture. Most non-Christians are praying for it daily. It would make the planet a much nicer place to live on!

    While Mr. Brown's own bias is as plain as can be, this is all a sideshow. Regardless of who the trial judge is, or who the Court of Appeals judges are, what counts is the final decision in the case. That will be rendered by the Supreme Court and, at best, it will be 5 - 4 there is no Constitutional right to gay marriage. This case is a loser - sadly.

    the truth is, it's all part of the game. If the tables were turned and the judge was mormon, our side would be screaming bloody murder. Anthony Kennedy is the only judge that matters.

    I guess a gay judge would be biased, but a straight judge wouldn't? No Latino judges for a case involving a Latino and another race? No female judges for cases involving women? That's right-wing logic for you. The same logic that says if two men on one side of the state get married, that will cheapen the marriage of straight couple on the other side of the state. A judge makes his or her decision based on the law, and uses the law when writing the decision. It doesn't matter, in this case, either way the judge rules because it will be appealed, and a higher court will review the case.

    This is a desperate strategy/tactic by the right to weaken the judge and tarnish his reputation. The judge should just ignore these claims and keep doing what he's doing. The right can't go by merit alone so they always play dirty tricks. The left should get some balls and counter-attack and right for always being a bully. Gay marriage will be reality eventually so why are they even fighting it?
