Prop 8 to Judge: Invalidate 18,000 Marriages

The supporters of Proposition 8 are urging U.S. district court judge Vaughn Walker to invalidate the 18,000 marriages of same-sex couples who were legally married in California before the ballot initiative barred gay and lesbian couples from marrying in the state.

As the trial before the judge winds down Wednesday with closing arguments from both sides, pro-Prop. 8 attorney Andrew Pugno said the move would honor the "expressed will of the people," according to the San Francisco Chronicle. He said that his clients are not asking for a complete nullification of the marriages, but he urged that state agencies, courts, and businesses not have to recognize the unions.

    This article makes no sense. A federal judge doesn't have the authority to interpret state law differently than a state's highest court.

    Isn't it just like a group who have a Constitutional Amendment protecting them to be able to believe in whichever "religion" they want to spread their hate and undermine the legal process and so, limiting freedoms of others. It's time to BOYCOTT any businesses related to the Legal Discriminating Society.

    Fortunately the "will of the people" doesn't always prevail as the Civil Rights movement of the 1950s and 1960s proved. Sometimes it takes a few US Supreme Court decisions and Federal marshalls to usher in change. As history shows us, that is likely what we will be looking at. Since before the Civil War we have been faced with the un-fulfilled promise of the Declaration of Indpendence, stating that we are all created equal and are endowed by the creator with inalienable rights to life, liberty, and the pursuit of happiness. Nowhere did it say, except if you happen to be a woman, non-white, homosexual, older, and/or have a mental or physical disability. I am excited to live the day when I can marry the man I want and have no worry of discrimination. Until then I will remain hopeful.

    I can't wait for this to be over, and I'm not even a California resident. I hope they can prove that the right thing to do may not always be based on it's popularity at the time. Someday people will feel ashamed for voting for this hurtful measure and hopefully the Mormon Political church will stay out of politics in the future, or pay their share of taxes. Because the government misses out on billions of dollars on taxes each year to churches, every dollar of which is made up by each and every taxpayer regardless of personal beliefs, I feel this is a highly unethical practice and it adds insult to injury to the gay community knowing they pay more taxes so the church doesn't have to.

    At one time the 'expressed will of the people' kept blacks in segregation! Would those who support Prop 8 like to see THAT reinstated? Step up to the plate, boys... OWN YOUR BIGOTRY! These are the same people who chose to hide behind anonymity and fight to have their identies kept secret. They're more like a modern-day 'KKK' than anything else. Prop 8 is UNCONSTITUTIONAL, on its FACE. It MUST be overthrown and same-sex marriage equality again legalized in California. What REALLY worries these 'christians' is that once California again legalizes S-S marriage; the rest of the nation will begin to follow suit as the UN-constitutionality of same-sex marriage bans, nationwide, comes into the spotlight. One thing is sure; this WILL, ultimately, end up before the U.S. Supreme Court.

    My partner of 31 years and I are one of the 18,000 couples who married during the open window (June-November 2008). We live in this state of marriage hibernation. It's legal, but will it last? (It will as far as we are personally concerned!) Why don't we all slap bumper stickers on our cars and trucks that finger the biggest financial backer of Prop 8: "Tax Mormons." Nevertheless, like Anne Frank, I believe that people are good at heart; so I know we will one day soon gain our civil right. Meanwhile, may I add, it is slightly embarrassing to socialize around other GLBT couples who wish to marry because the "marriage window" put us in a special class, and made us "different." This kind of divide-and-conquer is like a new kind of psychological Christian torture.

    Moving isn't the answer. Rights that require travel and even 6 months of residence are basically limited to the well-off. You don't have full civil rights if you're paying a lawyer and accountant to get some of the benefits straight people get from a stop at city hall.
