California May Require Condoms in Porn

California's AIDS Healthcare Foundation will file a petition to amend state law to mandate that all adult-film stars use condoms.

The change would be made to the California Occupational Safety and Health Standards Board's policy on blood-borne pathogens.

“Although workers in adult films should enjoy protections under the current phrasing of the regulation, the adult film industry has steadfastly refused to take any steps to protect its workers from diseases spread by blood-borne pathogens, resulting in thousands of employees becoming infected with sexually transmitted diseases," said Michael Weinstein, President of AIDS Healthcare Foundation.

In August, AHF filed 16 worker-safety complaints with the board over the lack of condom use in adult films made in California. The Los Angeles Department of Public Health has documented an epidemic of sexually transmitted diseases among workers in the adult film industry, according to the petition. Porn stars are 10 times more likely to be infected with an STD than the rest of the population. The department has documented 2,013 individual cases of chlamydia and 965 cases of gonorrhea among workers between the years 2003 and 2007.

    Joe in Fort Worth: If you want ignorance and sexual fascism, look at yourself. Wearing a condom should always be a personal choice, not a mandate from the state. It doesn't matter if money changes hands or not. Money doesn't carry STD's. I am sorry some people are so self hating that they do not protect their own health and say no to unprotected sex, drugs, etc. I suggest you make the rules for yourself, if anyone wants you in Ft. Worth, and quit trying to do so for others. As it was pointed out here, even sex workers have a choice and many advertise "NO BAREBACK". You can never successfully force people to have the kind of sex you want them to. They have to WANT to use condoms.

    The reason why HIV/AIDS & other STDs are still so rampant in our society is due to the ignorance of many, including sadly most of the posters here. Condoms are easily the best defense against HIV/AIDS & other STDs. Wanting porn actors to forgo condom usage - & risk their lives or health - in order for you to get off is cruel. And there is no "in the bedroom" privacy issue here b/c the porn actors are part of an industry, to which OSHA standards rightfully apply.

    I wonder if the law is really directed more at straight porn than gay? I read somewhere that in gay porn the actors wear condoms much more often than in straight porn and that OSHA was taking notice of this. I'm thinking that the law might not be directed at the individuals who choose to do porn as much as it is at the industry who produces it. As a healathcare provider I wear gloves anytime I thiink there will be a chance that I come in contact with blood/body fluids. OSHA doesn't mandate this with just my interest in mind but also for the protection of the people I come into contact with. Anyway what somebody else said was probably true. The producers and directors will just choose a location where they can make exactly the kind of video they want to.

    I am very happy that the poster "Chelsea in Durango" doesn't make the porn DVD's that I buy. Condoms should always be used at the will of the people involved, not required by any law. I am not interested in the porn actors/actresses complaining they made a film without condoms. Did they ever hear of saying NO? I was a prostitute for five years and refused to see clients if they didn't wear a condom. My choice. It is silly to complain to the government when YOU decided to have unsafe sex, no gun was held to your head. But we live in a society where everything is always someones elses fault. Spare me the violins.

    One of the basics of gay rights would be: Don't make the rules for others in bed. If this Aids foundation wants to promote condom use by public campaigns telling why condoms are a good idea, fine. They should not call upon the law or the police to force other people to use condoms in films or in the private bedroom. What's next, no s/m allowed? Think we obeyed when gay sex was banned? I'm tired of sexual fascists and will not donate to them. I can tell you this will only create hostility to wearing condoms. Personally, I use condoms for anal sex. Not for oral sex. I am healthy. Some people think I'm taking risks but it isn't for others to judge. It is my body and I have health insurance and money if I get sick. Mind your own business. You are not protecting sex workers by making more police intervention. If this stupid Aids foundation keeps it up, people will just throw the condoms in the toilet.

    Chelsea, using your argument, condoms should also be required for oral sex. Do you really think that's a good idea? Taking it a step further, perhaps protective goggles should be worn be performers to protect them from bodily fluids.

    I'm surprised at the negative feedback. Wearing a condom is no different from wearing a hard hat on a construction site. It's for the safety of everyone.

    I don't think there is any constitutional authority to mandate any performer to purchase and wear a product. Those that participate in this type of film work should be aware that it is well known that STD and STIs are rampant in this industry, however they are, far as i know, under control. Since making a porno is voluntary so should wearing a condom as well. The porn industry is already regulated enough as it is to prevent and control STIs but I think that the SCOTUS will eventually throw it out as unconstitutional. I would though say that wearing a condom is something that those watching porn should do, not just the performers.
