Exclusive: Lieberman Introduces DADT Repeal Bill

Update: Independent senator Joseph Lieberman of Connecticut on Wednesday introduced the Senate’s first “don’t ask, don’t tell” repeal bill along with 11 Democratic cosponsors including Sen. Carl Levin of Michigan, who chairs the Senate Armed Services Committee, but no Republicans.

“To me, it’s very important that we repeal this law, both because it’s fair and consistent with basic American values of equal opportunity,” Lieberman told The Advocate, “but also because it’s a very positive step for the military to take in terms of military effectiveness and readiness.”

The legislation, called the Military Readiness Enhancement Act of 2010, would repeal the 1993 law that banned lesbian and gay soldiers from serving openly in the military and replace it with a policy that prohibits discrimination against service members on the basis of their sexual orientation. Lieberman explained that the nondiscrimination provision would make the change “more permanent legislatively,” so a future administration couldn’t revert back to something akin to “don’t ask, don’t tell” by executive action.

Lieberman, who has opposed the ’93 law since its inception, said ending the policy has significant support and that he would push for passing the bill this year, although he wasn’t sure he had the 60 votes necessary to overcome a filibuster.

“I think a guess right now — and this is really a guess — if this bill came to a vote tomorrow, we’d have over 50 votes and that’s saying a lot,” he said. “Do we have 60? Not clear yet, but possible.”

But Lieberman also said he had spoken with Chairman Levin “preliminarily” about including the legislation in this year’s defense authorization bill before it’s passed out of committee.

“That’s something that I’m happy to consider and, of course, it’s very important to have the chairman’s support for that,” Lieberman said, noting that including a measure in committee would have “the procedural advantage” of forcing opponents to find the 60 votes needed to strip out the measure once it reached the floor. If the opposition failed to amass those votes, they would have to filibuster the entire defense authorization bill, which would include many other provisions they might hesitate to obstruct, such as an increase in compensation for military personnel and funding for various defense systems.

    Lieberman scares me when I see him with McCain. McCain knows why DADT should remain. Unless theres a better policy to ensure cohesion in the military w/o socializing it, a form of DADT has to remain. If one makes a choice, one should be the beneficiary of that or one should burden the shame of it. Not the bystanders. The pro-gay groups don't want to respect our choice not being gay, hence they try to normallize it in the minds of the public. Just close your door, period.

    Familiarity breeds contempt.....Continue to jam gayism down the throats of Americans and a backlash will ensure. Not against gays individually, but against any conceptionalizing of the choice as normally accepted practices. Its simple: Just close the door. That way the choosing of gay practices becomes only of that of the participants. Otherwise, straights will need special protection against gay incursions....c the supidity of the gay pursuit? More gov't intervention. Just because a road is built, doesnt mean we have to drive on it, so dont built that road.

    @Terry Stevens this is a continuation from previous comment. You talk about adultry, sodomy etc..do you honestly think this doesn't go on now or has gone on in the past? If so you are a blind fool. It happens all the time WITH HETEROS! Sexual orientation is not going to increase prostitution or have a need for Congress to make changes in Regulations. Legalized marriages gay or straight should get same benefits, common law gay or straight you get nothing. Simple as that. Why make a mountain out of a molehill. Maybe you were raised in a very religious upbringing, or you just don't like gays, but please take this into consideration, people are people no matter the sexual orientation. We all want to love, be loved, be happy, financially secure and have families. Why should sexual orientation even be an issue. Repeal DADT and continue to march! So many have served and died for this country. let them be open, out and proud. They are not going to turn you gay if that is your fear

    @Terry Stevens with all due respect you sound like a total homophobe! I am a straight female, retired from the US Army. You sound like a young Military Officer in the JAG office. San Antonio, I would suspect Ft. Sam Houston or Lackland, depending if you are Army or USAF. I retired in 1999 with over 20 years service and the military never recognized common law marriage as far as Dept of Finance (DFAS) went. Why should that change if DADT is repealed? If you have legally wedded LGBT couples they should have the exact same benefits as heteros. Recruiting and retention, you need a reality check! Gays and lesbians have been serving since the beginning and we all know it and knew many of them and made friends. Gays & lesbians want to serve like anyone else, and many make better soldiers etc. You're talking about prostitution going up and changing rule and regs, you really need to get a grip. Repeal DADT will allow gays to serve openly and receive the same benefits as heteros. contd

    There are many questions to resolve prior to repeal of DADT. Changes to Title 10 USC, Federal EEO, Discrimination and Hate laws, the UCMJ and State Laws concerning homosexuality. Military pay implications for gay couples. Assignment Policy in DoD Dir 1315.7. Unknown impact on recruiting and retention—especially retention. If gays are allowed do we create a quintuple military society consisting of Heterosexual, Gay, Lesbian, Transvestite and Transsexuals? Military installations Tattoo Artists, Fast Food Restaurants, Pawn Shops, Loan Sharks and Prostitutes will expand. Personal safety issues for declared gays has always been a consequence of self-identification. Will Congress legalize sodomy, adultery, prostitution and common law marriage? If so, will the new law include heterosexuals? Provided sodomy is no bar to entering the military, then should we not review all enlistment restrictions? Too many questions prior to just saying, OK, no more DADT. Give DOD a chance to finish study.

The Tea Partiers threw him under the bus and now he's trying to burnish his credentials as a Democrat, by getting on the 'Repeal DADT' bandwagon. I trust NOTHING he says or does! The Senate would be a hell of a lot better without him.

    Once we've finally done away with Don't Ask Don't Tell, will all the men and women who were booted out and dishonorably discharged be offered reinstatement, and have their military records expunged of black marks and disgrace? That would seem the right and proper thing to do. And does this mean Lieberman is finally coming out of the closet, might as well, he's been the GOP's bottom for years. :)

    I'll have to wait to see what happens, but HOW MANY TIMES have we all been told that so & so is pretty much a "sure thing?" Am I wrong to be suspicious? And apparently, THEY MAY NOT EVEN NEED 60 VOTES TO PASS THIS! The democrats may use a procedure called "RECONCILIATION" to pass healthcare. It only requires a simple majority to pass and it can't be fillibustered. SO WHY NOT USE IT TO REPEAL DADT? The GOP is never going to support repealing the policy. IF THE REPEAL OF DADT FAILS IT'LL BE BECAUSE THE DEMS WANT IT TO FAIL. I think I'll be switching to the Green Party AFTER the Fall 2010 elections. That'll give Obama & the Dems each time to grow a pair and get something done.

    I just got an email from Lt. Dan Choi asking me to call Sen. Bill Nelson and ask for his support on this issue. I laughed. Bill Nelson is one of the biggest homophobes on the hill (and one of the oldest - right up there with Robert Byrd). His only interest is bringing home enough pork to guarantee his next election. He should be prosecuted for bankrupting the treasury while trampling individual rights.

    I don't like Joe Lieberman because of what he did to health care. However, he has been a consistent supporter of equality, and that position is something he has never wavered on. I still wouldn't vote for him given the chance (it's not hard to find a pro-gay rights Dem in CT to run for Senate) but I certainly won't deride him or doubt his legitimate support on this bill either.
